The Law Society have now issued their response to the proposals for a new probate fee structure. The proposals are that instead of the flat rate fee for an application for a grant of probate (£215 for an individual application or £155 for an application made through a solicitor), fees will be charged according to the value of the estate starting at £300 where an estate exceeds £50,000 increasing to a maximum of £20,000 for estates exceeding £2 million.
The Law Society response successfully highlights the problems with the proposals and echoes the views of many, especially that "the proposed increases are excessive, particularly for high value estates".
The various responses to the consultation are now being considered.
The Law Society has responded to the Ministry of Justice’s (MoJ) consultation on proposals to reform fees for grants of probate. The proposals would see fees based on the value of the estate with the top end increasing to £20,000 for estates valued over £2 million.
