Topshop has been successfully sued for using Rhianna's image on T-shirt without her consent. She claimed that the use of the image was damaging to her brand/goodwill. In the UK we have no protection of image rights. The copyright in a photograph belongs to photographer. Rhianna's case was that people buying the T-shirt might have thought that she was endorsing a Topshop garment but this was not the case. Topshop was implying to the public a false connection between Rhianna and their T-shirt. This was the English civil law claim of "passing off". Rhianna successfully showed that Topshop was passing off the T-Shirt as endorsed by her.
The Court of Appeal in London upheld a ban on the store selling a sleeveless T-shirt featuring a photo of the star without obtaining her permission. In the first successful celebrity case of its kind, three appeal judges agreed marketing the item without Rihanna's approval amounted to "passing off".
